Welcome to Safe Water! The terms "we," "us," and "our" refer to Safe Water LLC. Safe Water LLC operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Safe Water LLC is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide to us is correct, current, and complete and that you have all rights necessary to provide such information.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion, subject to applicable law.

SECTION 2 - OUR PRODUCTS

We have made every reasonable effort to provide accurate representations and descriptions of our products and services in our online store. However, colors, images, dimensions, specifications, and product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.

Product photographs and descriptions are provided for informational purposes and may not represent the exact appearance of every individual product.

We do not warrant that the appearance, quality, specifications, functionality, or performance of any products or services purchased by you will meet your expectations or be identical to representations displayed in our online store, except as expressly provided by us in writing or required by applicable law.

We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, household, geographic region, or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase the products identified in your order. Safe Water LLC reserves the right to accept or decline your order for any reason, including product availability, pricing errors, suspected fraud, shipping restrictions, or other circumstances, subject to applicable law.

Your order is not accepted until Safe Water LLC confirms acceptance and processes your payment.

We must receive and process your payment before your order is accepted and processed for fulfillment.

Please review your order carefully before submitting it. Once an order has been accepted or entered into processing, Safe Water LLC may be unable to accommodate cancellation requests.

If you request cancellation of an order and Safe Water LLC agrees to cancel the order, a 3.4% transaction/cancellation fee may be deducted from the amount refunded to you to account for transaction processing costs.

Orders that have already shipped generally cannot be cancelled and must instead be handled in accordance with our Refund Policy.

In the event that we do not accept, modify, or cancel an order, we will attempt to notify you by contacting the email address, billing address, and/or telephone number provided when the order was placed.

Your purchases are subject to return, refund, and exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and are not being purchased for unauthorized commercial resale, redistribution, or export.

Safe Water LLC currently sells and ships products only within the United States. We do not accept orders for international delivery or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product or service will generally be the price displayed at the time the order is placed and will be set out in your order confirmation email.

Unless otherwise expressly stated, posted prices may not include applicable sales taxes, shipping, handling, or other charges.

Prices posted in our online store may differ from prices offered by third-party sellers or other retailers.

We may offer promotions from time to time that affect pricing. Such promotions may be governed by separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern with respect to that promotion.

Charges incurred by you will be honored by your payment provider; and
You will pay all charges incurred by you at the prices displayed at the time of purchase, including applicable shipping charges and taxes.

If a pricing or billing error occurs, we reserve the right to correct the error and, where appropriate, cancel or modify the affected order.

SECTION 5 - SHIPPING AND DELIVERY

Safe Water LLC ships orders only within the United States.

Shipping and delivery dates are estimates only and are not guaranteed unless expressly stated otherwise in writing.

We are not liable for shipping or delivery delays caused by shipping carriers, weather, natural disasters, labor disruptions, incorrect or incomplete addresses, carrier errors, government actions, or other events beyond our reasonable control.

You are responsible for providing an accurate and complete shipping address at checkout.

If an order is returned to us because of an incorrect or incomplete address supplied by you, additional shipping charges may apply before the order can be reshipped.

Once we transfer products to the shipping carrier, title and risk of loss may pass to you to the fullest extent permitted by applicable law.

We are not responsible for losses, theft, or damage occurring after delivery to the shipping address provided by you, except where otherwise required by applicable law.

Safe Water LLC is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our Store are made directly with Safe Water LLC.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales or transactions between you and Safe Water LLC, including any injury, damage, loss, defect, refund, return, delivery issue, or other matter resulting from products purchased from Safe Water LLC.

You hereby expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Safe Water LLC, to the fullest extent permitted by applicable law.

(iii) not mimic human behavior for the purpose of evading technical restrictions or access controls;

(iv) not circumvent or complete CAPTCHAs or similar measures intended to distinguish automated access from human access;

(v) respond truthfully to questions or prompts seeking to determine whether interactions are being conducted by a human or computer; and

(vi) not circumvent or otherwise avoid measures intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

We may terminate this agreement or your access to the Services, or any portion thereof, in our sole discretion at any time, with or without notice, subject to applicable law.

You will remain responsible for all amounts due up to and including the date of termination.

Termination of your access to the Services shall not relieve you of any obligations or liabilities that arose before termination.

The following sections will continue to apply following termination: Intellectual Property, Feedback, Errors, Inaccuracies and Omissions, Prohibited Uses, Agent Terms, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

We do not warrant the accuracy, completeness, reliability, or usefulness of this information.

WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, SAFE WATER LLC DOES NOT WARRANT THAT PRODUCTS WILL BE SUITABLE FOR EVERY CUSTOMER'S PARTICULAR PURPOSE, APPLICATION, BOAT, VESSEL, SYSTEM, ENVIRONMENT, OR INTENDED USE.

You are responsible for determining whether a product is appropriate for your particular use and for following all applicable product instructions, warnings, installation requirements, maintenance requirements, and applicable laws.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL SAFE WATER LLC, ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, OR SHOPIFY AND ITS AFFILIATES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, business interruption, loss of use, loss of goodwill, or any similar damages, whether based in contract, tort, negligence, strict liability, warranty, or otherwise, arising from or related to:

To the fullest extent permitted by law, Safe Water LLC's total aggregate liability arising out of or relating to these Terms, the Services, or any product purchased through the Services shall not exceed the amount actually paid by you to Safe Water LLC for the specific product or service giving rise to the claim.

Some jurisdictions do not allow limitations of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.

(3) your misuse of the Services or any product purchased through the Services;

(4) your negligence, fraud, misconduct, or intentional wrongdoing; or

(5) your violation of any rights belonging to Safe Water LLC, Shopify, or any third party.

We will notify you of any indemnifiable claim, provided that failure to promptly notify you will not relieve you of your obligations except to the extent you are materially prejudiced.

We may control the defense and settlement of any indemnified claim at your expense, including the selection of counsel.

We will not settle any claim that requires you to assume non-monetary obligations without your consent, which shall not be unreasonably withheld.

You agree to cooperate fully in the defense of indemnified claims, including by providing relevant documents and information.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles, except to the extent federal law applies.

To the fullest extent permitted by applicable law, any legal action, proceeding, or dispute arising out of or relating to these Terms, the Services, or any transaction with Safe Water LLC shall be brought in the state or federal courts located in Richmond County, New York, and you and Safe Water LLC consent to the personal jurisdiction and venue of such courts.

Nothing in this section prevents Safe Water LLC from seeking appropriate equitable or injunctive relief in any court of competent jurisdiction where necessary to protect its intellectual property, confidential information, or other rights.
